Service Charges
We charge a service fee of 7% on the total gifts actually purchased from your registry.
When we send you a check or electronic funds
transfer, we deduct the 7% from your total gifts, and send you the remainder.
As well, if you arrange your travel
through our travel specialists, you may be eligible for a discount on your service fees.

We have no signup fee. We charge your wedding guests a transaction fee of 3% of the price of the item as shown in your
registry.
If your guests choose to have us print and mail a gift card, we add a charge of $1.65 for postage and handling.
Terms of Use
TheBigDay provides this Terms of Use ("Agreement") to you as a user of www.thebigday.com.
By using www.thebigday.com, you are indicating your willingness to be bound by all of the terms of this Agreement.
If you do not wish to be bound by this Agreement, please do not use www.thebigday.com.
Your retention of tickets, reservations, or bookings after issuance shall constitute consent to this Agreement, and an agreement on your
part to convey the contents hereto to your travel companions or group members.
We reserve the right to change the terms and conditions of this Agreement at any time and without prior notice to you,
but such changes will be effective only when they are posted to this site. You agree to be bound by all of the terms of this and all
future Agreements, as long as you use www.thebigday.com.
By registering to become a member at www.thebigday.com ("Member"),
you attest that all information provided by you in the registration is true and accurate.
To become a Member, you must provide some of the information requested in the registration form.

Member Conduct
You agree to use www.thebigday.com for lawful purposes only. You may not use, or allow others to use,
your www.thebigday.com membership, either directly or indirectly, to:
Post or transmit any content that is abusive, vulgar, obscene, hateful, fraudulent, unlawful, threatening, harassing or defamatory;
Post or transmit any matter that you do not have a right to transmit under law (such as copyright-protected material)
or under contractual or fiduciary relationships (such as nondisclosure agreements);
Harass or threaten any Member of www.thebigday.com or any other person or entity;
Harm minors in any way;
Post, transmit, promote, link to or facilitate the distribution of any content that can be construed as libel, slander, harassment,
hate speech, obscenity, pornography or cruelty to animals;
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity,
including the forging of headers or other manipulation of identifiers in order to disguise the origin of any content or transmission
source;
Post, transmit or facilitate the transmission of statements that are intentionally false or misleading;
Post, transmit or facilitate the transmission of chain letters or pyramid schemes;
Post, transmit or facilitate the transmission of any unsolicited advertising, charity request, promotional materials or other
forms of solicitation;
Offer, sell or purchase any registered or unregistered securities;
Violate any software license agreement;
Violate any applicable local, state, national, international or foreign law or regulation;
Post or otherwise transmit software viruses or other computer code, files or programs designed to inhibit, block or jam the
functionality of computer software, hardware, or telecommunications equipment;
Collect or store personal data about other users;
Engage in unapproved commercial activity;
Send unsolicited e-mail ("spam").
You agree that TheBigDay may at any time, and at its sole discretion, terminate your membership without prior notice to you
for suspected violation of the above provisions.
As a user, you are responsible for protecting your password.
You agree that you will be responsible for any and all statements made while using this site, and acts or omissions that occur,
through the use of your membership and password. If you have reason to believe or become aware of any loss, theft,
or unauthorized use of your membership account or password, notify TheBigDay immediately.
Member-Provided Content
You understand that all information, text, messages, and any other material posted on www.thebigday.com by
Members ("Member Content") is the sole responsibility of the person from which such Member Content originated.
This means that the member, not TheBigDay, is entirely responsible for the content uploaded, posted or otherwise transmitted by the Member.
TheBigDay does not control the Member Content that is posted and therefore does not guarantee the accuracy or integrity of the
Member Content. In addition, you acknowledge that you may be exposed to content that is offensive or objectionable to you.
TheBigDay's Rights Regarding Member Content
TheBigDay does not claim ownership of the Member Content you place on www.thebigday.com.
Except as limited and regulated by our Privacy Policy, by placing content on www.thebigday.com you grant TheBigDay
an unlimited license to republish, reproduce, modify and adapt the Member Content for the purpose of administering and
promoting www.thebigday.com.
While TheBigDay does not and cannot review all transmissions by Members, you acknowledge that TheBigDay
reserves the right to, and may from time to time, monitor any and all information transmitted or received
through www.thebigday.com.
TheBigDay, at its sole discretion and without further notice to you, may review,
remove or prohibit Member Content that TheBigDay deems inappropriate or that violates any term or condition of this Agreement.

TheBigDay Content
TheBigDay Content is defined as any information, data, text, messages, articles, software, methods or processes, photos,
video, graphics, music, sounds and any other material or services that are found on www.thebigday.com,
excluding Member Provided Content.
By accepting this Agreement, you agree that all TheBigDay Content is the sole property of TheBigDay
and www.thebigday.com and its licensors shall retain all right, title and interest in and to the Content,
which may not be reproduced without prior written consent of TheBigDay.
All TheBigDay Content herein is protected under US and international copyright, trademark and other laws and is only intended
for the personal use of the Members.
You may not modify, publish, retransmit, participate in the transfer or sale of, copy (other than temporary copies that may appear in or
be created by your browser), create derivative works of, distribute, perform or display any of the TheBigDay Content
in any way, except that you may make one copy for your personal use.

www.thebigday.com may provide links to other Internet sites or resources.
You acknowledge that TheBigDay is not responsible for the availability of, and does not endorse or assume responsibility for,
any content, products, policies or other materials on such sites, nor does it assume any responsibility for your reliance on or use
of content, products or other materials obtained from such sites.
TheBigDay Advertising
You acknowledge that TheBigDay has the right to advertise and post promotions on www.thebigday.com.
You acknowledge that site users may not advertise or post promotions on www.thebigday.com without express permission
from TheBigDay.
Indemnity
You agree to indemnify, defend and hold harmless TheBigDay from and against any claim, liability, cost,
damage or loss it may incur (including, without limitation, attorneys fees) as a result of
(i) your use of Member Content or TheBigDay Content;
(ii) any content provided by you;
(iii) any violation by you of your obligations under this Agreement; and
(iv) any violation by you of the rights of others.
Trademarks
The trademarks, logos, and service marks (collectively the "Trademarks") displayed on www.thebigday.com are the registered and
unregistered Trademarks of TheBigDay and others.
Except as provided in this Agreement or by written permission of TheBigDay, your use, appropriation or misrepresentation of
the Trademarks displayed on this site is strictly prohibited. TheBigDay will aggressively enforce its intellectual property
rights to the fullest extent of the law.
No Resale of Services
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes the service provided by
the www.thebigday.com web site or its use or access.
Practices Regarding Use and Storage of Data
TheBigDay may place limits on the use and storage of data on our website.
For example, TheBigDay may limit the length of time that Member Content can remain on the site,
or set limits regarding maximum or minimum levels of activity.
You agree that TheBigDay will not be responsible or liable for the deletion of messages or content
on the www.thebigday.com site, and agree that TheBigDay reserves the right to terminate accounts that are
inactive for an extended period of time without notice.
TheBigDay reserves the right to change our practices regarding the use and storage of data on www.thebigday.com
at anytime without notice to users.
Travel Risks
You assume complete and full responsibility for, and hereby release TheBigDay from any duty of, checking and verifying any and
all passport, visa, vaccination, or any other entry requirements of each destination, and all safety and security conditions at such
destinations, during the length of the proposed travel.

contact the Travel Advisory Section
of the U.S. State Department.
For medical information, call the U.S. Public Health Service.
By embarking on your travel, you voluntarily assume all risks involved in such travel, whether expected or unexpected.
You are hereby warned of such risks, and are advised to obtain appropriate insurance coverage against them.
Disabilities
Any disability requiring special attention should be reported to TheBigDay at the time you make your reservation.
TheBigDay will make reasonable attempts to accommodate special needs, but we are not responsible for any denial of services by carriers,
hotels, restaurants, and other independent suppliers.
If you require extraordinary assistance, you must be accompanied by a companion who is capable of and totally responsible for
providing the necessary assistance.
Disclaimer of Warranties
To the best of its knowledge, the information and services provided to you by TheBigDay are accurate.
You acknowledge that TheBigDay expressly disclaims all other warranties of any kind, whether express or implied,
regarding the completeness, truth, accuracy, non-infringement, merchantability or fitness of the content found herein for any
particular purpose. All information provided on www.thebigday.com is to be used on an "as is, at will with all faults" basis.
Further, TheBigDay makes no warranty that service will be uninterrupted, timely, secure or error-free, that any files available
for downloading will be free of viruses, worms or other code that manifest contaminating or destructive properties,
or that the quality of any services, information, or other material will meet your expectations.
You acknowledge that although TheBigDay may provide you with the opportunity to support
charitable and/or other non-profit organizations through the use of our services,
you understand that TheBigDay is a privately owned company.
You further acknowledge that TheBigDay is not responsible for the transactions you may conduct with the
charitable/non-profit organizations as a result of your use of the TheBigDay services.
TheBigDay is not responsible for monitoring, confirming, or reviewing the conduct, status, representations,
or other actions or omissions of the charitable/non-profit organizations.
You agree that TheBigDay will not be held liable to anyone for any loss or injury resulting from your direct or
indirect use of www.thebigday.com.
This includes, but is not limited to, loss or injury caused in whole or in part by contingencies beyond TheBigDay's
control in procuring, compiling, interpreting, reporting, operating or delivering any portion of www.thebigday.com.
Further, you agree that TheBigDay assumes no responsibility for any and all transactions you may conduct with any parties as a
result of your use of the TheBigDay services. Some jurisdictions do not allow the disclaimer of such warranties,
so this may not apply to you, but the disclaimer will apply to the furthest extent allowed by law.
Disclaimer of Liability
TheBigDay sells travel provided by hotels, resorts, tour operators, airlines and cruise lines.
Neither TheBigDay nor its suppliers shall be held liable for personal injury, death, property damage or accident,
delay or irregularity arising out of any act or omission of these suppliers.
TheBigDay is acting as a mere agent for suppliers in selling travel-related services,
or in accepting reservations or bookings for services that are not directly supplied by this travel agency
(such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.).
TheBigDay, therefore, shall not be responsible for errors and omissions on the part of such suppliers,
which result in any loss, damage, delay, or injury to you or your travel companions or group members.
We choose our suppliers carefully, but cannot guarantee any of such suppliers' rates, bookings, reservations, connections, scheduling,
or handling of personal effects.
TheBigDay shall not be responsible for any injuries, damages, or losses caused to any traveler
in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases,
local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions,
or conditions outside TheBigDay's control.
You acknowledge that TheBigDay will not be liable for any direct, indirect, incidental, special, consequential or
exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses
(even if TheBigDay has been advised of the possibility of such damages), resulting from or related to the use or
inability to use www.thebigday.com.
Some jurisdictions do not allow the waiver of such damages, so this may not apply to you, but the waiver will apply to the furthest
extent allowed by law.
Taxation Consequences
You acknowledge that TheBigDay makes no claims or promises regarding any and all tax obligations or consequences that
may result from your activities as a Member of www.thebigday.com and your use of the services provided by www.thebigday.com.
Furthermore, you agree that TheBigDay has no obligation to maintain records or provide you with documentation of your transactions
with charitable/non-profit organizations for tax reporting purposes.
Miscellaneous
If any provision in this Agreement is invalid or unenforceable under applicable law, it will be enforced to the furthest extent
possible and the remaining provisions will continue in full force and effect. This Agreement, your rights and obligations, and all
actions contemplated by this Agreement will be governed by the laws of the United States of America and the State of Oregon
(except with respect to choice of law), as if the Agreement were a contract wholly entered into and wholly performed in Multnomah County,
Oregon. Any dispute, controversy or claim arising out of or relating to this Agreement will be resolved exclusively in the federal or
state courts located in Portland, Oregon and you hereby consent to the jurisdiction and venue of such courts.
