We reserve the right to change the terms and conditions of this Agreement at any time and without prior notice to you, but such changes will be effective only when they are posted to this site. You agree to be bound by all of the terms of this and all future Agreements, as long as you use TheBigDay.com.

By registering to become a member of TheBigDay.com ("Member"), you attest that all information provided by you in the registration is true and accurate. • Violate any software license agreement;

• Collect or store personal data about other users;
• Engage in unapproved commercial activity;
• Send unsolicited e-mail ("spam").

You agree that TheBigDay.com may at any time, and at its sole discretion, terminate your membership without prior notice to you for suspected violation of the above provisions.

As a user, you are responsible for protecting your password. You agree that you will be responsible for any and all statements made while using this site, and acts or omissions that occur, through the use of your membership and password. If you have reason to believe or become aware of any loss, theft, or unauthorized use of your membership account or password, notify TheBigDay.com immediately.

Member-Provided Content
You understand that all information, text, messages, and any other material posted on TheBigDay.com by Members ("Member Content") is the sole responsibility of the person from which such Member Content originated. Indemnity

The trademarks, logos, and service marks (collectively the "Trademarks") displayed on GiftRegistry.com are the registered and unregistered Trademarks of TheBigDay.com and others. Except as provided in this Agreement or by written permission of TheBigDay.com, your use, appropriation or misrepresentation of the Trademarks displayed on this site is strictly prohibited. TheBigDay.com will aggressively enforce its intellectual property rights to the fullest extent of the law.

No Resale of Services
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes the service provided by the TheBigDay.com web site or its use or access.

Practices Regarding Use and Storage of Data
TheBigDay.com may place limits on the use and storage of data on our site. For example, TheBigDay.com may limit the length of time that Member Content can remain on the site, or set limits regarding maximum or minimum levels of activity. For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department. For medical information, call the U.S. Public Health Service. By embarking on your travel, you voluntarily assume all risks involved in such travel, whether expected or unexpected. You are hereby warned of such risks, and are advised to obtain appropriate insurance coverage against them.

Disabilities
Any disability requiring special attention should be reported to TheBigDay.com at the time you make your reservation. TheBigDay.com will make reasonable attempts to accommodate special needs, but we are not responsible for any denial of services by carriers, hotels, restaurants, and other independent suppliers. If you require extraordinary assistance, you must be accompanied by a companion who is capable of and totally responsible for providing the necessary assistance.

Disclaimer of Warranties
To the best of its knowledge, the information and services provided to you by TheBigDay.com are accurate. You acknowledge that TheBigDay.com expressly disclaims all other warranties of any kind, whether express or implied, regarding the completeness, truth, accuracy, non-infringement, merchantability or fitness of the content found herein for any particular purpose. All information provided on TheBigDay.com is to be used on an "as is, at will with all faults" basis. TheBigDay.com is acting as a mere agent for suppliers in selling travel-related services, or in accepting reservations or bookings for services that are not directly supplied by this travel agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.).

TheBigDay.com, therefore, shall not be responsible for errors and omissions on the part of such suppliers, which result in any loss, damage, delay, or injury to you or your travel companions or group members. We choose our suppliers carefully, but cannot guarantee any of such suppliers' rates, bookings, reservations, connections, scheduling, or handling of personal effects.

TheBigDay.com shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside TheBigDay.com's control.

You acknowledge that TheBigDay.com will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if TheBigDay.com has been advised of the possibility of such damages), resulting from or related to the use or inability to use TheBigDay.com. Some jurisdictions do not allow the waiver of such damages, so this may not apply to you, but the waiver will apply to the furthest extent allowed by law.

Taxation Consequences
You acknowledge that TheBigDay.com makes no claims or promises regarding any and all tax obligations or consequences that may result from your activities as a Member of TheBigDay.com and your use of the services provided by TheBigDay.com. Furthermore, you agree that TheBigDay.com has no obligation to maintain records or provide you with documentation of your transactions with charitable/non-profit organizations for tax reporting purposes.

Miscellaneous
If any provision in this Agreement is invalid or unenforceable under applicable law, it will be enforced to the furthest extent possible and the remaining provisions will continue in full force and effect. This Agreement, your rights and obligations, and all actions contemplated by this Agreement will be governed by the laws of the United States of America and the State of Oregon (except with respect to choice of law), as if the Agreement were a contract wholly entered into and wholly performed in Multnomah County, Oregon. Any dispute, controversy or claim arising out of or relating to this Agreement will be resolved exclusively in the federal or state courts located in Portland, Oregon and you hereby consent to the jurisdiction and venue of such courts.

BY USING TheBigDay.com YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS.
